CONDITIONS GOVERNING VISITORS AND MEMBERS’ USE OF THE VALOTECH GATEWAY
It is essential for both visitors and members to read through these conditions of use so that Valotech can ensure sound, efficient operation of its gateway. The rules set out below must be followed by gateway visitors, members and administrators alike so that everyone can take full advantage of the various services and resources offered on the Valotech site.
Valotech is very concerned about the protection of privacy on the Internet. The gathering, storage, use and communication of personal information by Valotech on the Internet and via electronic mail are conducted in compliance with the laws that apply in the province of Quebec, Canada.
This is the information that Valotech gathers, stores, uses or communicates.
Valotech collects or uses certain data by technological means that allow it to identify components of a visitor’s electronic environment. The identification data facilitate navigation on the Valotech gateway and are compiled to produce statistics that will be used to improve the gateway. Valotech collects the following data for this purpose:
1.1.1. IP Address
When you request a Web page on the Valotech site, your IP address is transmitted to the Valotech server so that it can execute the request.
1.1.2. Type of Browser and Operating System
Information about the type of browser and the type of operating system you are using is exchanged between your computer and the Valotech server to allow access to the site.
1.1.3. Site User Data
Valotech’s server also keeps track of the date and time when you access the site, the pages you go to and the address of the site from which you accessed Valotech’s site.
These data transmitted automatically between computers cannot identify you personally, and no links between the data collected will be made for this purpose.

If you decide to send personal information to us by means of electronic mail, we will use only the information required to respond to your e mail message and follow it up. However, we advise you not to send personal or confidential information to the above-mentioned e mail address.
1.3. On line Registration Forms
1.3.1. Registration Form
Valotech organizes a number of events each year. You can register for these events by means of an electronic form. You can also register to become a Valotech member.
If you register as an individual, your contact information as well as the other information requested on the form may be regarded as personal information. Valotech undertakes to keep all such personal information confidential at all times, and it will be gathered, used and communicated to third parties solely for the purpose of responding to and granting your request to register for the event or to become a Valotech member.
In some cases, Valotech will use the contact information you have provided to give you the opportunity to receive information about other events or services offered by Valotech. You will then have the choice of declining Valotech’s offer or of having your name deleted from the mailing list at a later date.
1.4. Services to Members
1.4.1. Use of Cookies
Cookies will be stored temporarily on your computer and will be deleted automatically after two months of inactivity.
1.4.2. Access to Member’s File
As a member, you can access your file to update or correct information at any time with the user name and password assigned to you by Valotech when your registration application is accepted.
It is important to keep in mind that your user name and password are the essential identification needed to access your membership file. Your user name and password are strictly personal and confidential and must not be disclosed to a third party under any circumstances. Should you have reason to believe that the confidentiality of your user name or password has been compromised, you have an obligation to notify Valotech as soon as possible so that the situation can be corrected and any unauthorized use of the information can be prevented.
Valotech assumes no liability for third-party use of a member’s user name and password.
2. LINKS TO OTHER SITES
The Valotech gateway contains hyperlinks to other sites. Valotech’s confidentiality policy ceases to apply to your personal and confidential information when you go to any of these sites via the links.
Valotech therefore assumes no liability with regard to the collection, use, communication or storage of personal and confidential information that transits through the sites for which hyperlinks are provided.
3. TRADEMARK AND INTELLECTUAL PROPERTY
3.1. Trademark
Valotech, together with its logo and icon related to the Valotech enterprise as well as its gateway and affiliated services, is a registered trademark. Unless a written agreement is reached between Valotech and another party, use of the services offered by the Valotech gateway in no way grants the right to use the Valotech trademark.
3.2. Intellectual Property
Copying, distributing, transmitting, disseminating, representing, reproducing, publishing, licensing, transferring or selling any information, software, product or service obtained from the Valotech gateway is prohibited, as is creating a work in any form whatsoever from the aforementioned elements obtained from the Valotech gateway.
Any use of the resources, services or other information contained on the Valotech gateway must make explicit, conspicuous mention of the source. For example, if you make references to the Valotech gateway, by means of hyperlinks, frames or any other technological means, these references must mention the source, that is, the Valotech gateway.
When you submit a work through the services offered on the Valotech gateway, by e mail, the bulletin board or the specialized discussion group, you must make sure you have complied with all the rules governing intellectual property. Accordingly, you shall have ownership of all rights to this work and shall not be bound by a confidentiality agreement that would prohibit you from disseminating the work. Upon dissemination of the work on the Valotech gateway, you shall grant to Valotech free of charge a non-exclusive licence to reproduce and disseminate the work.
4. LIMITED LIABILITY OF VALOTECH
The information contained on the Valotech gateway is provided solely for information purposes, and Valotech does not provide any guarantee regarding the reliability or accuracy of the contents of its gateway. You are therefore strongly advised to consult an expert in the specific field if you are planning to take specific action or make a decision on the basis of the information found on the gateway.
The hyperlinks to other sites allow you to obtain further information on various topics discussed on the Valotech gateway. However, when you access other sites via these hyperlinks, you leave the Valotech gateway, and Valotech is in no way responsible for the information and various products and services offered on those other sites simply by virtue of having provided the referring hyperlinks.
The Services to Members section offers a selection of informative articles by experts in various fields. Although these experts are recognized in their respective fields, Valotech does not provide any guarantee regarding the accuracy or content of the articles. You alone are responsible for any decisions you may make or actions you may take after reading these pieces. We advise communicating with the expert in question if you would like additional information.
In navigating on the Valotech gateway, you discharge Valotech of any liability in connection with losses suffered following the reading of information displayed on the gateway and following the use of products and services offered on the gateway.
5. APPLICABLE LAW
These conditions of use shall be governed by the laws applicable in the province of Quebec, and any dispute arising out of use of the Valotech gateway shall be submitted to the jurisdiction of the courts of the judicial district of Longueuil, Quebec.
